Areas of Practice

Employment

Employees have a right to not be discriminated against in the workplace. An employer cannot use an employee’s disability, race, age, gender, national origin, religion, or other protected classes, as a factor in determining the terms and conditions of the employee’s employment. Title VII and the Missouri Human Rights Act expressly prohibit sex discrimination, sexual harassment, disability discrimination/harassment, race discrimination/ harassment, national origin discrimination/harassment, age discrimination/ harassment, and retaliation in the workplace. Also, the Missouri Worker’s Compensation Law explicitly makes it unlawful for an employer to discriminate or retaliate against an employee for asserting a worker’s compensation claim or for fear that the employee may assert a worker’s compensation claim. There are also federal and state laws which prohibit employers from taking adverse action against employees for reporting unlawful activity. The attorneys at Murphy, Kinney, & Sumy have experience litigating all of these employment claims and more.

Personal Injury

Individuals who have suffered injuries at the fault of another are often entitled to compensation for their pain and suffering, medical expenses, emotional distress, loss of enjoyment of life, and other damages. Whether the accident involves a motor vehicle (car, motorcycle, semi-truck, boat, or other), slip and fall, being struck as a pedestrian, defective product, medical malpractice, or something else, if someone is injured as a result of an accident, they should consult with the attorneys at Murphy, Kinney, & Sumy to determine whether they have a viable personal injury claim.

Domestic

About 40 to 50 percent of married couples in the United States divorce. In some cases, a marriage can dissolve with minimal stress and both parties agreeing on central issues, without attempting to hurt one another. However, in the vast majority of cases, the dissolution of a marriage is difficult and stressful as one or both parties often disagree as to key issues and frequently choose to engage in vindictive tactics towards one another based on emotion. If you or the other party are like the majority of individuals in divorce cases, you will need a family law attorney to ensure that your rights and best interests are protected. Without a family law attorney representing you, you may face the loss of your property, your income, and even your children.

Criminal Defense

Missouri, like most states, has a complex criminal law system. The Missouri criminal statutes are found in Chapters 556-578 of the Revised Statutes of Missouri. There are a large number of criminal charges that can be filed, from minor violations to felony charges like driving while intoxicated. The criminal justice system is not the place to represent yourself. The criminal defense lawyers at Murphy, Kinney, & Sumy can guide you through the process and fight to preserve your legal and constitutional rights.

Traffic

Like taxes, traffic violations are a fact of life. Everyone gets them. Local governments utilize fines from traffic violations to fund government operation, similar to money generated from taxes. Whether the traffic violation is minor or more serious, major mistakes can be made if you attempt to handle the matter on your own, from paying high fines and court costs to even losing your driver’s license. An attorney who has handled both minor and more serious traffic violations can assist you in protecting your driving record, lower your fines, and preventing any points from being linked to your driver’s license.
